Terms of Use (Application)

1. Acceptance of terms

By using the Application you confirm that you have read, understood and accepted these Terms of Use and our Privacy Policy.

We reserve the right to amend these Terms at any time. We will notify you of significant changes via the Application or by e-mail. Continued use of the Application after notification of changes constitutes acceptance of the new Terms.

2. Description of service

The Application provides the following features:

• Solar production monitoring
• Monitoring and control of battery energy storage systems
• Electric vehicle charging management
• Energy consumption analysis and grid import/export tracking
• Energy reports, insights and savings estimates
• Notifications of power outages and system alerts
• Retrieval and display of weather data relevant to your location

The Application connects to your installed energy devices and, where applicable, to third-party API services (e.g. Huawei FusionSolar, SolarEdge, Enphase, weather services).

3. User accounts and access

Your access credentials for the Application are assigned by your installer. You are not authorised to register an account independently.

You are responsible for:

• Keeping your login credentials confidential
• All activities that occur through your account
• Promptly notifying your installing company of any unauthorised use

Your account and access to the Application may be terminated by Energycom d.o.o. in the event of a breach of these Terms or termination of the contractual relationship.

4. Acceptable use

You agree that you will not:

• Attempt to reverse-engineer, decompile or disassemble the Application
• Use the Application for purposes not covered by these Terms
• Attempt to gain unauthorised access to systems or data
• Transfer, sell or grant access to your account to third parties
• Use automated means (bots, scrapers) to access the Application
• Interfere with or disrupt the integrity or operation of the Application

5. Third-party services

The Application may display data retrieved from third-party service providers, including:

• Huawei FusionSolar (solar inverter data)
• SolarEdge (solar inverter data)
• Weather data providers (e.g. OpenWeatherMap)
• Electricity distributor (tariffs and grid data)

The availability and accuracy of third-party data are not within our control. Energycom d.o.o. is not responsible for interruptions, inaccuracies or changes in third-party services.

By using the Application you agree to the terms of use of the relevant third-party service providers.

6. Data accuracy and disclaimer of warranties

Data displayed in the Application (solar production, battery status, consumption, savings estimates, etc.) are provided for informational purposes only.

Energycom d.o.o. does not warrant the accuracy, completeness or continuity of real-time or historical data and accepts no liability for decisions made on the basis of information displayed in the Application.

Data availability may be affected by factors outside our control, including network conditions, unavailability of third-party API services or equipment failures.

7. Service availability

Energycom d.o.o. strives to ensure high availability of the Application but does not guarantee uninterrupted or error-free service.

The service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Technical failures or infrastructure issues
• Circumstances beyond our reasonable control (force majeure)

We do not guarantee a service level (SLA) to end users. SLA terms, where applicable, are defined in the agreement between the installing company and Green Energy Pal d.o.o.

8. Intellectual property

The Application and all its content - including software, design, graphics, text and interfaces - are the property of Green Energy Pal d.o.o. or are licensed by it.

Energycom d.o.o. holds a licence to distribute the Application to end users under its own brand.

We grant you a limited, non-exclusive, non-transferable licence to use the Application on personal devices solely for the purposes set out in these Terms.

You may not reproduce, distribute, modify or create derivative works based on the Application without prior written consent.

9. Privacy

We process your personal data in accordance with our Privacy Policy. By using the Application you agree to the terms of our Privacy Policy.

10. Limitation of liability

Energycom d.o.o. is not liable for:

• Indirect, incidental, special or consequential damage arising from use of the Application
• Loss of revenue, profit or data
• Decisions made on the basis of data or recommendations displayed in the Application
• Damage arising from service unavailability or third-party failures

To the extent permitted by applicable law, the total liability of Energycom d.o.o. is limited to the amount you paid for the service in the preceding 12 months, or 100.00 EUR if no payment was made.

11. Termination and suspension

Energycom d.o.o. may suspend or terminate your access to the Application without prior notice if:

• You breach these Terms of Use
• Your installation agreement expires or is terminated
• There is suspicion of misuse or unauthorised access

Upon termination, the rights granted to you under these Terms cease. Provisions that are by their nature permanent (limitation of liability, intellectual property, governing law) remain in force.

12. Governing law and jurisdiction

These Terms of Use are governed by and construed in accordance with the law of the Republic of Croatia.

For all disputes arising from or in connection with these Terms, the Commercial Court in Zagreb shall have jurisdiction, unless consumer protection legislation provides otherwise.
